T&Cs of Transport
1. Definitions
- SNEA refers to the transportation service provider, including its subsidiaries, workers, agents, and subcontractors.
- Goods include any items, packages, or freight delivered to SNEA for transportation.
- Transportation encompasses all activities related to the transfer of goods, including collection, handling, loading, unloading, distribution, and delivery.
- Customer refers to the sender, recipient, or any entity that holds a real right over the goods.
- Prohibited Item refers to goods whose transportation is prohibited by law or company policy.
2. Application of Conditions
- The Customer accepts these terms when delivering goods for transport, even if they haven't signed a waybill.
- These conditions bind all entities involved in the transport, including subcontractors.
- Any conflicting instructions from the Customer that are not written or signed by the SNEA are not binding.
3. Customer Obligations
- The Customer must package goods properly to prevent damage, complete documentation accurately, and ensure goods are secured before delivery.
- The Customer is responsible for not delivering prohibited or dangerous items and ensuring goods comply with the required conditions.
- The Customer must ensure the goods are delivered on time and confirm the state of the goods upon receipt.
4. Excluded Goods & Refusal of Shipments
- SNEA does not accept prohibited items or goods exceeding weight, size, or volume limits.
- SNEA has the right to refuse, delay, or return shipments that violate laws or these conditions.
5. Tracking and Inspection
- All shipments are subject to security screening and may be inspected by the SNEA PORTADOR DIARIO public authorities.
6. Carrier, Transportation, and Itinerary
- SNEA may choose the transportation method and subcontract parts of the transport while applying these conditions.
7. Dispatch
- The Customer may appoint a SNEA as an agent for customs clearance, providing the necessary documentation and paying additional fees.
8. Goods Delivery Time
- The delivery time depends on the delivery time of the delivery of goods to SNEA and the type of service selected.
9. Liability of the Daily Carrier
- SNEA is liable only for losses due to their serious fault, and their liability is limited to the declared value or market value of the goods.
- The Carrier's liability is limited for goods transported by air under the applicable international conventions.
10. Exclusion of Liability
- SNEA is not responsible for indirect losses (e.g., loss of income or profits) or delays caused by events outside its control, such as weather, accidents, or force majeure.
- They are also not responsible for damages after delivery to the recipient or if the goods are improperly packaged or labeled.
11. Damages and Claims
- Claims for damages must be made in writing within 5 days of the scheduled delivery date.
- The Customer must provide documentation to support claims for loss or damage and may not deduct claims from transport payment until paid.
12. Rates and Payment
- The Customer is responsible for transport costs, including taxes and additional fees for incorrect weight or service details.
- Payment is due upon delivery of goods unless otherwise agreed.
- SNEA can retain goods or sell them to recover unpaid fees.
